Terms and Conditions
The use of Reytrip site or of any other Reytrip platform («our Platform») is subject to the terms and conditions («Terms») set out below. By accessing our Platform, you, the user of our Platform, confirm that you agree with these Terms and with our Privacy Policy.
The content and the information presented on our Platform, as well as the software and the system used for the provision of such content and information constitute our property.
We may modify these Terms from time to time according to our judgement. By accessing our Platform you consent to be bound by any modifications applied to the present Terms. Therefore, we advice you to check these Terms regularly. If you do not agree with the present Terms or with their future modification, you must not use our Platform.
Our Platform
Our Platform is a travel services search engine. Reytrip is not a travel agency or merchant and does not provide, control or own the travel products presented in or to which access is provided through our Platform («Travel Products»). The Travel Products are provided, controlled or/and owned by third parties, such as the airline and travel agencies («Providers»). Reytrip bears no responsibility towards you as far as travel product bookings or/and purchases are concerned. Your bookings are subject to the terms and conditions as well as to the privacy policies applied by the Travel Providers. Therefore, make sure that you understand them and that you agree with them before you proceed with your booking.
Using our Platform
The use of our Platform is allowed on the condition that it is performed as provided by the applicable laws and Terms. Our Platform may only be used by individuals of an appropriate age that are in a position to enter into binding contracts.
It is your responsibility to make sure that all the information you provide us with are accurate and updated. Moreover, you are responsible for the confidentiality and the safety of any login details, as well as for every use of our Platform performed by any person using your account with or without your permission. In case you suspect that there has been an unauthorized use of your account or your code or any other security breach, you hereby agree to notify us promptly.
Your access to our Platform may be terminated, suspended or restricted at our discretion without notice and without the company bearing any responsibility towards you.
You also agree not to:
use our Platform for any purpose that is illegal, hazardous or otherwise unacceptable or inappropriate, as determined by us,
impersonate any person or entity or make false declarations or in any way deceit concerning your relation to a person or an entity, including without limitation Reytrip or the Travel Providers,
share, transfer or otherwise dispose of any material from our Platform in violation of the rights of any third party or of the applicable law,
share, transfer or otherwise dispose of any material that you do not have the right to dispose of,
share, transfer or otherwise dispose of any unwanted or unauthorized advertising, advertising material or any other form of invitation,
share, transfer or otherwise dispose of any material containing software viruses or any other computer code, files or programs that are designed for the interruption, the destruction or the restriction of the functioning of any software or equipment or telecommunications equipment material,
affect or disrupt the functioning of our Platform or of the servers or the networks that are connected to our Platform,
use our Platform for any commercial purpose,
use our Platform in any way that could cause damage or/and be defamatory for Reytrip,
copy, distribute, share with the public, sell, rent, lend or otherwise exploit our Platform,
breach or circumvent any security measures that are used for the prevention or restriction of your access to our Platform,
remove, replace or modify any company names, trademarks, logos or other designations of origin from our Plarform, or to present or attempt to present our Platform as being the product of any third party,
access the website using any manual or automated procedure to perform scanning, copying, indexing, classification or any other exploitation of our Platform.
Limitations of our liability
Our Platform contains websites managed by third parties («Third-Party Websites»). These sites are provided for your information and we do not in any way support the content of any Third-Party Websites. We do not operate for the benefit of, control or are in any way responsible for any Third-Party Websites. Reytrip assumes no liability on behalf of them or regarding any losses or damages that may occur as a result of your use of them. The use of Third-Party Websites is subject to their terms, conditions and privacy policies.
We (along with the executives, the directors, the employees, the representatives, the subsidiaries, the providers and the third parties), to the extent permitted by the law, assume no liability and no obligation regarding (a) any inaccuracies or omissions in the content appearing on our Platform and (b) any losses or damages or viruses that may infect your computer’s equipment or any other property as a result of your access to our Platform or of any downloading of any content from our Platform, (c)any injury, death, loss, claim, force majeure, fortuitous event, delay or any direct, special, exemplary, moral, indirect, incidental or consequential loss or damage of any kind (including without limitation any lost profits or savings) that is based on any contract, wrongful act (including negligence), offence, strict liability or otherwise, arising from or related to: (i) your access or use of or the inability from your part to access or use our Platform or any content provided therein, or (ii) the operation or operation failure by us or by any other provider, even if we have been informed on the possibility of damages related to these or to other parties or to any other party. Depending on your country/state of residence, the restrictions mentioned above may not apply or partly apply to you.
Your liability
You hereby agree to defend, compensate and hold us and all of our executives, directors, employees and representatives harmless of and against any claims, causes of action, demands, recoveries, damages, compensations, fines, penalties or other charges or expenses of any kind or nature, including without limitation any legal or accounting fees arising from (or in any way connected to) the access or use of our Platform by you and the breach of the present Terms or of any applicable law.
Disclaimer
You are using this service exclusively at your own risk. The service is provided «as is» and «as available». Although we usually provide a large number of search results, which we aim to be accurate and updated, we cannot guarantee the inclusion of every available provider and offer or the reliability and accuracy of the content presented. Reytrip explicitly disclaims all warranties of any kind, express or implied, including without limitation any implied warranties of title, of non infringement, of fitness for a particular purpose, of merchantability, of accuracy and safety, as well as any warranties arising from the use of the commercial service, the course of the transaction or the performance.
Our intellectual property
You hereby agree not to copy, reverse engineer or attempt to discover any source code, and not to distribute or create derivative work based on our Platform, in whole or in part. You agree not to access our Platform in any way other than through the interface provided by Reytrip to enable access to our Platform. Moreover, all intellectual property rights, including without limitation any software, pictures, texts, trademarks, copyrights and other material making part of our Platform, are owned by or have been attributed to Reytrip, its subsidiaries or its partners. The use of this material is permitted exclusively for personal, non commercial purposes.
Your intellectual property
We respect third parties’ intellectual property rights. If you think that part of the material presented on our Platform is infringing your trademark or copyrights, please contact us immediately.
Bookings
Our Platform provides an interface to facilitate your bookings with the Travel Providers. All travel product bookings or/and purchases you make through our Platform are settled between you and the Travel Providers. Reytrip does not set the price and fees for, own or control any travel products that you can book or/and purchase after being redirected from our Platform. Reytrip is not responsible for any of the Travel Products that you can book or/and purchase after being redirected from our Platform. You hereby agree to settle any claims or disputes arising from the booking or/and the purchase of any Travel Products with the Travel Provider and not with us. Furthermore, any bookings or/and purchases of any Travel Products that you make after being redirected from out Platform are subject to the terms, conditions and privacy policies applied by the Travel Provider.
BONUS
Most booking options that you find through our Platform give you the possibility to pick a BONUS, once you complete your booking on the Website of the Travel Provider you have chosen. A BONUS represents the products and services offered at special prices or even free by several partner enterprises. Most bookings are accompanied by specific alternate BONUS options and you have the right to choose one of them.
Our Platform only provides an interface to facilitateyour communication with the BONUS Providers. Reytrip does not set the BONUS options and does not own or control any of them. All BONUS options appearing on our Platform are to be settled between you and the BONUS Providers. You hereby agree to settle any claims or disputes related to any BONUS with the relevant BONUS Provider and not with us. Moreover, the BONUS you have chosen is subject to the Provider’s terms, conditions and privacy policies.
You also are aware and accept that you must choose your BONUS immediately after you complete your booking. The BONUS options for each booking have the form of either a discount or a special price, or they can be completely free, and they are available at a specific number and for a specific period of time. Reytrip bears no responsibility in case of unavailability or exhaustion of the BONUS options and is not required to foresee any of these cases; this is why we recommend that you choose your BONUS right after you complete your booking.
Reytrip bears no responsibility regarding any damages, modifications or any issues that might occur in relation to the products or services provided. You hereby agree to settle any claims, disputes or issues arising in relation to the said products/services with the partner enterprises and not with us.
Termination
You hereby agree that your access to our Platform may be terminated, suspended or restricted by us at our discretion without notice and without the company assuming any responsibility towards you or any third party.
General Information
Any failure from our part to impose any of these Terms under any circumstances shall be deemed as a waiver of any of them or of our right to impose any of these Terms in the future.
In case any of these Terms is held to be inapplicable or invalid by a court of a competent jurisdiction, then such term will be enforced to the greatest extent allowed by the applicable law, without affecting the validity or the applicability of any other Terms.
The present Terms constitute the entire agreement between us as far as the use of our Platform is concerned and they replace any terms, conditions, agreements and arrangements previously in force regarding the use of our Platform.
To the extent permitted by the law, Cypriot law governs the present Terms as well as any disputes that may arise either from these Terms or from the use of our Platform. You hereby agree to take legal actions that may arise solely in the Courts of Cyprus, and you irrevocably and unconditionally consent and are subject to the exclusive jurisdiction of the said courts as far as any lawsuit, legal act or procedure arising from the present Terms is concerned. You agree, to the extent permitted by the law, that any claims, disputes and legal issues related to our Platform or/and the present Terms will be resolved individually, without taking any form of collective action.
Comments
By submitting feedback, suggestions, ideas or any other form of comments («Comments»), you irrevocably assign ownership of all rights on the material submitted to Reytrip. Furthermore, by providing Comments, you provide us with the universal, irrevocable, permanent, non-exclusive, transferable, fee-free permission, with a sublidensing right, to use, copy, adjust, modify, distribute, license, sell, transfer, publicly display, publicly execute, transmit, emit, access, project or otherwise exploit the Comments we receive by you for any purpose whatsoever, including without limitation any business or advertising purposes.
